Sexual Orientation Harassment

California Government Code § 12940 (j) makes it unlawful for an employer, labor organization, employment agency, apprenticeship training program, any training program leading to employment, or any other person, to harass an employee, an applicant, an unpaid intern or volunteer, or a person providing services pursuant to a contract on account of their sexual orientation, perceived sexual orientation or because of the sexual orientation of the person that they are associated with.

Sexual Orientation Harassment includes using offensive, homophobic, or biphobic language, name-calling, or using anti-LGBTQ+ slurs. Invasive inquiries about an individual’s intimate relationships, sex life, or sexual orientation. Making disparaging remarks or insisting that someone does not act “straight,” “masculine,” or “feminine” enough. Intentionally disclosing someone’s sexual orientation to others without their consent. Making frequent anti-LGBTQ+ jokes or “teasing” that crosses the line into creating a toxic environment. Intentionally ignoring or freezing out a colleague because of their sexual orientation.

Sexual Orientation Harassment also includes sending harassing, abusive, or demeaning emails, texts, or messages. Defacing personal or workspace property (such as cubicle walls or dorm doors) with anti-gay graffiti. Physical violence, threats, or aggressive posturing directed at someone due to their sexual orientation. Inappropriate physical contact, lingering intimacy, blocking someone’s path, or gestures of a sexual nature based on bias.
