Racial, National Origin and Ancestry Harassment

California Government Code § 12940 (j) makes it unlawful for an employer, labor organization, employment agency, apprenticeship training program, any training program leading to employment, or any other person, to harass an employee, an applicant, an unpaid intern or volunteer, or a person providing services pursuant to a contract because of their race, national origin, or ancestry, because of their perceived race, national origin or ancestry or because of the race, national origin or ancestry of the person that they are associated with.

Racial Harassment includes using racial slurs, derogatory remarks, or making offensive “jokes” about a person’s race, color, or ethnicity. Mocking someone’s cultural background, accent, native language, food, or traditional clothing. Displaying racially offensive symbols, cartoons, objects, or imagery (e.g., in the office, on personal desks, or in digital messages/emails). Making assumptions about an employee’s abilities, intelligence, or behavior based on their race, such as repeatedly making “backhanded” compliments or dismissive comments about their cultural heritage.  Allowing supervisors or coworkers to use racial epithets, derogatory comments, or “jokes” based on race. Displaying highly offensive or intimidating imagery (e.g., swastikas, confederate flags, nooses) in employee workspaces. Or repeatedly mocking a coworker’s hairstyle, accent, cultural food, or behaviors.
