Disability Harassment

California Government Code § 12940 (j) makes it unlawful for an employer, labor organization, employment agency, apprenticeship training program, any training program leading to employment, or any other person, to harass an employee, an applicant, an unpaid intern or a person providing services pursuant to a contract because of their disability.

Disability harassment may include using derogatory nicknames, slurs, or regularly mimicking an employee’s speech impediment, tic, or mobility issue. Repeatedly telling “jokes” about a person’s mental health or physical limitations. Constantly singling a person out to ask if they are “feeling okay” or capable of doing their work in front of peers, causing public humiliation. Consistently excluding a disabled individual from important team meetings, collaborative projects, or workplace social events based on assumptions about their abilities. Or intentionally interfering with approved assistive devices (e.g., hiding a wheelchair ramp, unplugging screen-reading software), or mocking the need for ergonomic accommodation.
