Sexual Orientation Discrimination

California Government Code § 12940 (a) makes it unlawful for an employer to discriminate against an employee or an applicant for employment on the grounds of their sexual orientation, perceived sexual orientation or because of the sexual orientation of the person that they are associated with.

Sexual Orientation discrimination may include passing over a highly qualified candidate for a job or promotion simply because they are known or believed to be a part of the LGBTQIA+ community or because they are associated with a person that belongs to the LGBTQIA+ community. Making derogatory comments, name-calling, spreading rumors, or making offensive jokes about an individual’s sexuality.

Handing out negative performance reviews, warnings, or being fired due to prejudice regarding an employee’s sexual orientation, or because of the sexual orientation of the person that they are associated with, while forgiving similar infractions by heterosexual staff. Offering workplace benefits (e.g., family leave, gym memberships, or travel discounts) to employees with opposite-sex spouses or partners, while explicitly denying them to employees with same-sex partners. 

Excluding employees from important meetings, networking events, or refusing to assign them to specific clients or roles out of bias about how customers might react. Or asking intrusive or inappropriate questions about an employee’s private relationship, intimate life, or dating choices.
