Race, National Origin and Ancestry Discrimination

California Government Code § 12940 (a) makes it unlawful for an employer to refuse to hire, to fire, suspend, discriminate or discipline an employee or applicant for employment on account of their race, national origin or ancestry.

Race, National Origin or Ancestry discrimination may include passing over a highly qualified candidate for an interview based on their name or racial background, while hiring similarly qualified or less qualified candidates of a different race. Requiring English-only fluency for a role where it is not necessary, specifically to filter out non-native candidates or certain minority groups. Paying employees of certain races, national origin or ancestry less than their counterparts despite identical roles, experience, and performance records. Systematically passing over qualified employees of color for promotions in favor of white peers, while providing limited mentorship or professional development opportunities. Assigning minority employees to less visible accounts, less desirable territories, or heavier physical workloads. Subjecting employees of certain racial groups to excessive performance monitoring or harsher penalties. Suspending, firing, or issuing formal write-ups to minority workers for minor infractions (like tardiness) while excusing similar or worse behavior from white coworkers. Or enforcing grooming and dress-code policies that effectively prohibit hairstyles naturally associated with certain races—such as prohibiting natural afros, locs, braids, or twists.
