Age Discrimination

California Government Code § 12940 (a) makes it unlawful for an employer to refuse to hire or to fire or discriminate against any person on account of their age.

Age discrimination may include excluding older employees from key strategic meetings or removing them from high-profile projects under the assumption they cannot handle new technology. Passing over a qualified, experienced older worker for a promotion in favor of a younger, less-experienced candidate, or denying them professional development. Laying off an older person or eliminating an older employee’s role only to hire a younger person to do the same job under a different title, or reducing an older employee’s responsibilities to force them to quit.
